Return Policy

Effective October 15, 2010

Wockhardt USA LLC Customers, both direct and indirect: Please contact Inmar Pharmaceutical Services for Returns Authorization (RA) as instructed below. Wockhardt USA LLC requires that all returns be authorized and accompanied by a completed Return Authorization. All products should be returned in a secure package. Issuance of Return Authorization does not guarantee credit.

Options available to request a return authorization:

1. The most efficient way to obtain your return label and track the progress of the return is by visiting Inmar’s RA website at https://clsnetlink.com (You will be required to upload a debit memo in PDF format).

2. E-mail debit memo to rarequest@inmar.com.

3. Fax debit memo to 817-868-5343.

Credit will only be given to customers who have purchased products directly from Wockhardt USA and Morton Grove Pharmaceuticals. Customers must have an open and active account in order to receive credit for approved returned or destroyed merchandise. Authorized returns are limited to the following manufacturer’s label codes 64679 (Wockhardt) and 60432 (Morton Grove).

Please contact Wockhardt Customer Service at (866) 931-2098 for any product that was ordered and shipped in error or damaged in transit or is a concealed damage for further instructions on these returns. Inmar will not accept product returns of this nature.

Products Eligible for credit:

In-date products with less than 6 months remaining shelf life.

Expired products not more than 12 months past expiration date.

Products in original containers.

Product returned within 30 days of return authorization.

Partial bottles in mandated states only.

Products ineligible for return credit:

Products may be returned for reasons below, however, credit will not be issued.

Products that are more than 12 months past, or greater than 6 months prior to expiration.

Overstock of products which are considered in date.

Products with stickers, marked, coded, dated, damaged, soiled or adulterated in any way.

Products sold on a non-returnable basis.

Products provided free of charge as a promotional incentive.

Products which proof of purchase cannot be verified.

Products damaged or deteriorated due to conditions beyond manufacturer control, such as improper storage or handling, heat, exposure to fire, smoke, water, earthquake, or other natural disaster or catastrophic event.

Product not in sealed original container.

Partial bottles of product, except where state mandated.

Product involved in distressed, sacrifice, fire, or bankruptcy sale.

Returns which exceed 30 days from date of return authorization.

Products received with concealed damages not reported within 60 days.

Repacked or private label merchandise.

TRANSPORTATION CHARGES:

Transportation and insurance charges on all returned merchandise are the responsibility of the customer.

Credit Terms for Returns:

For direct customers credit will be calculated at the lower of the most recent purchase price, current contract price or prevailing published list price. Wockhardt USA does reserve the right to make the final determination of credit.

For indirect purchases credit will be given at a calculated average contract price. Wockhardt USA does reserve the right to make the final determination of credit.

All return credit will be in the form of a credit memo issued to an active customer account.

Wockhardt is not responsible for any other additional fees from its customers using third party processors.

All credit differentials are due and payable within 30 days.

All unauthorized deductions made by customers will be subject to a percentage handling fee and reverse of cash terms.

Any claims not meeting the above guidelines will not be accepted, and no credit will be issue.
